1.Before making your order

Please read these terms and condition carefully confirming FAQ before using this website. By entering this website, and any other site accessible from this site "you" the User accept without limitation the Terms and Conditions "Terms" of Azito "we, us our" set out herein together with any terms and conditions that may be set out by the Image Owner and any additional terms and conditions set out on any other related site or in connection with any promotion or service within such sites. Please be advised that the purchase should not simply be for resell to any third party.

2.Order Receipt and processing

All orders are subject to these Terms and we will attempt only to offer those items and services that are readily available at the time of order but acceptance of order will be subject to availability. All steps during the order process are intended to be simple and give you the opportunity to change amend delete or correct all or any part of your order requirements. Any specific conditions for acceptance of order, delivery date and grand total will be indicated on the relevant page of each work. On placing an order you authorize us to transmit and update information about you and to obtain from third parties. Other information that will include but not be limited to your address and shipping address. All information and details provided by you must be true accurate complete and up to date. No contract shall exist between you and us until we confirm acceptance of your order by e-mail. Please note that your order made on the Internet is only accepted and that we cannot reserve any art work for you.

3.Price of the Art works

All prices stated are in US dollar and are valid unless and until amended by us. Where an inadvertent error arises in any stated price we reserve the right to correct such and will offer you the opportunity to cancel your order or proceed at the correct price. The prices in display include relevant charge for delivery, such as, packing, shipping and insurance and the cost of frame. We will arrange delivery to any location within the range of our appointed International Carrier, If you wish to buy several works at the same time, please contact us so that in some cases, we might be able to send the works together and reduce your shipping cost otherwise, we cannot give you any discount.

4.Purchase

The process of purchasing is as follows;
Step 1:
In the chosen Individual Artwork page, click "Buy" button to shop it.
Step 2:
Log in to your PayPal account or click "Continue" to process without creating a PayPal account.
Please be advised that we only accept PayPal payment in US dollar.
Step 3:
Fill in the necessary fields under personal Information.
Step 4:
Click 'Pay Now' to send your order to us via Paypal system.
Step 5:
On receiving your order as described, we will send you the confirmation by email. We deem the sale agreement to be reached when you received the email. We will not accept cancellation and return after the agreement of sale is reached.

5.Payment

You may choose PayPal only.

6.Shipping

Delivery times: Delivery Times stated are our best estimate at the time of order in the display page of each work. Under normal circumstances your purchase will reach you in fourteen to twenty days. Please be advised, however, that 60 days tops would take for it to be received by you under the circumstances at gallery's or artist's end.
Shipping and insurance cost: Shipping and Insurance cost are included with the grand total in a display page of the work.
Import/ Consumption tax: Import/ Consumption tax is to be notified by the dispatch company when you receive your purchase. Please arrange it at your end according to the requirement.
Delivery: Once your order has been processed and payment received, the artwork will be quickly dispatched and delivered to you by a dispatch company. We will deliver only to a permanent address given to us at time of order and you should note we cannot accept P.O. Box numbers, Hotels, Temporary or Accommodation addresses. Please note that we, Azito, have no responsibility to any damage caused by delayed delivery that is the responsibility of the dispatch company.

7.Cancellation and Return

We will not accept any cancellation and return after the agreement of sale is reached. However, if you received the wrong item or if there is a quality issue or damage, please contact us by email in five days after the artwork reached your address. We will not accept any claim and refund requirement after five days have passed since the artwork reached your address.

8.Limitation of liability

In no event shall Azito be liable for lost profits or any special, incidental or consequential damages to property and claims of third party arising out of or in connection with our site, our service or this agreement even if we have been advised of the possibility of such loss or damages were reasonably foreseeable.

9.Indemnify

You agree to indemnify, defend and hold us and all our directors, officers, employees, information providers, the Image Owners licensors and partners harmless from and against any and all liability and costs including without limitation legal fees and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms. You will co-operate as fully as reasonably required by us in our defense of any claim. We reserve the right at our expense to assume the exclusive defense and control of any matter and you shall not in any event settle any matter without our written consent. Those who choose to access this website do so at their own risk and are responsible for compliance with all local laws to the extent any such local laws are applicable.

10.Limited Licence and Copyright

You are granted a limited licence to download material contained on this website to a personal computer for the purpose of selecting your requirements for processing through our on-line purchase system. Any other use of any or all the materials on this website including reproduction modification distribution or republication is strictly prohibited and is a violation of our proprietary rights. We, Azito and as the case may be the Image Owner's suppliers, our suppliers, the Image Owner and Licensors retain all right title interest and intellectual property rights. You may not distribute sell or transmit any material and you are not permitted to alter modify or adapt the material including but not limited to translating decompiling reverse engineering or creating derivative works of the software and all content included on this site, such as text, graphics, logos, button icons, images, and HTML source. It should be noted that all artists retain copyright in their own artwork.

11.Suspension and Termination of Services

Without prejudice to these terms and conditions we may suspend or discontinue this website and service or your access to the same or any other site at any time with or without cause and with or without notice.
Additionally by using this website you accept that the Internet uses elements and relies upon services input and facilities which are not within our control or that of the Image Owners, our Licensors Information Providers and if we or they are totally or partially prevented or delayed in the performance of any of our or their obligations in providing a particular service such a situation will constitute force majeure and we or they shall be excused the performance for so long as such a situation endures.
We reserve the right to suspend or terminate any use by you of this website where it appears to us that your use is in breach of these Terms including the provision of false registration details or other misuse of the services offered through this website and we may pursue any other remedy legally available to us if you fail to comply with any of your obligations contained in these Terms.

12. Our Privacy Policy

We do not sell or share your information with any third parties for any reason. In general, we gather information about all of our users collectively. We only use such information anonymously and in the aggregate. When you submit personal information to us, it's used only in the following ways: to build your account with us, process your order and send you future information, regarding special promotions, etc. This information also helps us determine what is most beneficial for our customers, and how we can continually create a better overall experience for you.

15. Governing Law

These Terms shall be construed in accordance with and governed by Japanese law and each party agrees to submit to the exclusive jurisdiction of the Tokyo district court.
